This page (together with the documents referred to on it) is the License Agreement between you or the entity that you represent and Infinitix InfoTech governing your use of Infinitix InfoTech’s range of products’ (hereinafter also “Licensed Software”). By using the Licensed Software you confirm that you are agreeing to be bound by the following terms and conditions. By proceeding to download and install Licensed Software (or any updates to this Software that we may make available from time to time), you agree to the terms of this page and your use of such Software (including any updates) will be in compliance with these Terms and Conditions. If you do not agree to these, we are unwilling to license our Software to you. In this case, you may not download or install our Software and you must discontinue the download or installation process. You agree that: You are responsible for maintaining the security, integrity, health and backups of your database. Infinitix InfoTech can’t and won’t be liable for any loss or damage from your failure to comply with this obligation. You will not use the Licensed Software for any illegal or unauthorized purpose. You will not, in the use of the Licensed Software, violate any laws in your jurisdiction (including but not limited to copyright laws). Infinitix InfoTech reserves the right to update and change the Terms and Conditions / EULA from time to time without notice. Any new features that augment or enhance the current Licensed Software, including the release of the updates, shall be subject to these Terms and Conditions. Continued use of the Licensed Software after any such changes shall constitute your consent to such changes. Infinitix InfoTech grants to you a non-exclusive, non-transferable, Evaluation License for trial and evaluation of the Licensed Software, in binary object code form, for a period of thirty (30) days from the date of download or installation. This License begins upon downloading or installing the Licensed Software and ends thirty (14) days thereafter (“Evaluation Period”). If you are not willing to use the Licensed Software, after the Evaluation Period, delete all the copies installed in your computer with immediate effect. You are forbidden from using the Licensed Software for any other use or otherwise offering it for resale under the terms of this Section Infinitix InfoTech retains all rights not specifically granted to you herein. You agree that you will not change the system date in order to make the trail key work beyond the initial trail period allotted to you. You agree that you will not use more than one trail keys on the same computer in order to extend the trail period.
As part of your choosing to license the Licensed Software, Infinitix InfoTech grants you a fee-bearing, non-exclusive, non-transferable, world-wide license to Use the Licensed Software, including user documentation that you have downloaded from or received on media provided by Infinitix InfoTech, including all updates provided through the Infinitix InfoTech ‘s subscribed support services, where applicable, provided that such access and Use of the Licensed Software is in accordance with the Computer Id it was granted for by Infinitix InfoTech. “Use” means storing, loading, installing, executing or displaying the Licensed Software. “Computer Id” is the unique computer identification number generated by the Licensed Software. One copy of the Licensed Software can be installed only on one machine. To install the Licensed Software, internet connection is made mandatory. Internet connection is not required when uninstalling the software. As part of the installation or registration process Infinitix InfoTech will collect information such as contact person, mobile number, email address, business name & address. This information will be available in Infinitix InfoTech CRM (Customer Relationship Management) to serve you better. You agree to: • Provide true, accurate, current and complete information; and • Promptly notify us to update the information provided during the installation or registration to keep it true, accurate, current, and complete.
ou agree to use the Licensed Software solely for your use or the entity that you represent. You agree not to enable public performance or other activities prohibited by applicable copyright law. You agree not to: Apply the same license to more than one computer; Remove any copyright, trademark or other proprietary notices from the Licensed Software or its copies; Make any copies except for one back-up or archival copy, for temporary emergency purpose; Rent, lease, license, sub license or distribute the Licensed Software or any portions of it on a standalone basis or as part of your application; Modify the Licensed Software; Reverse engineer, decompile or disassemble the Licensed Software. Allow any third parties to access, use or support the Licensed Software Resell, transfer or sub-license any aspect of the Licensed Software;
Infinitix InfoTech is not responsible for support, customization or development carried out by third party suppliers engaged by you. Wehaso Solution Private Limited is not responsible for commitment entered into by a third party that could represent an obstacle to the performance of these Terms and Conditions.
Infinitix InfoTech provides support that includes email support for problem reporting, remote computer control support for problem resolution, product updates, and online access to product documentation. To avail the Technical Support, explicit purchase of Infinitix InfoTech AMC(annual maintenance contract – valid for one year) is required.
Infinitix InfoTech does not warrant that the Licensed Software will be error-free. Except as provided herein, the Licensed Software is furnished “as is” without warranty of any kind, including the warranties of merchantability and fitness for a particular purpose and without warranty as to the performance or results you may obtain by using the Licensed Software. You are solely responsible for determining the appropriateness of using the Licensed Software and assume all risks associated with the use of it, including but not limited to the risks of program errors, damage to or loss of data, programs or equipment, and unavailability or interruption of operations.
Infinitix InfoTech has the right to audit your Use of the Licensed Software by providing at least seven (7) days prior written notice of its intention to conduct such an audit at your facilities during normal business hours.
You agree that all agreements and transactions between you and us will be done electronically. You agree to receive all notices and terms regarding the Licensed Software either by (a) e-mail to you, by (b) we post them on the web page of our website. To receive electronic notices, you must have access to the Internet and a current version of an Internet browser. You will need to provide your own printer if you want to print any of our terms
